General Terms and Conditions
General Terms and Conditions (GTC) – Limousine Service
1. Scope of Application
These General Terms and Conditions apply to all contracts, services, and offers provided by the limousine service [JM Drive], hereinafter referred to as the “Provider.” Any conflicting terms and conditions of the customer shall not apply unless the Provider has expressly agreed to their validity in writing.
2. Conclusion of Contract
A contract is concluded upon written confirmation (via email, online form, or in writing) of the booking request by the Provider.
3. Services
The scope of the contractually agreed-upon services is set forth in the respective booking confirmation. Additional services not listed in the booking confirmation will be billed separately.
4. Prices and Payment Terms
All prices are quoted in euros and include the applicable statutory value-added tax, unless otherwise stated.
Payment is to be made—depending on the agreement—in advance via bank transfer or credit card, or on-site to the driver in cash or by debit/credit card.
5. Customer Obligations
The customer agrees to:
not carry any prohibited substances or dangerous items,
treat the vehicle with care,
follow the instructions of the driver.
6. Liability
The Provider is liable only in cases of willful misconduct and gross negligence. In cases of slight negligence, the Provider is liable only for breaches of material contractual obligations. Liability is limited to typically foreseeable damages.
The Provider assumes no liability for the Customer’s personal belongings.
7. Cancellation Policy
Cancellations must be made in writing (email is sufficient).
The cancellation fees are as follows:
Up to 48 hours before departure: free of charge
48 to 24 hours before departure: 50% of the agreed fare
Less than 24 hours before departure or no-show: 100% of the fare
In the event of cancellation by the provider due to force majeure (e.g., severe weather, strike, accident), there is no entitlement to compensation. In this case, any payments already made will be refunded in full.
8. Waiting Times
Waiting times at the pickup location exceeding 15 minutes will be charged additionally, unless they were caused by the provider. Billing is calculated in 30-minute increments according to the currently valid price list.
9. Data Protection
The collection and processing of personal data are carried out in accordance with applicable data protection laws. Further details are set forth in the privacy policy on our website.
10. Jurisdiction and Governing Law
The place of jurisdiction is—to the extent permitted by law—the provider’s registered office. German law applies.
11. Severability Clause
Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
